MDDP among the leaders of the Tax Advisory Firm Ranking by the Rzeczpospolita daily
MDDP experts topped this year’s Tax Advisory Firm Ranking by the Rzeczpospolita daily in three categories:
- Monika Dziedzic – leader in International Taxes
- Alicja Sarna – leader in Tax Controversy and Litigation
- Tomasz Michalik – leader in VAT
The best in proceedings
MDDP (together with Counsel Iwona Jakubiak) was awarded in the category of landmark rulings for the prestigious case concerning the use of wiretapping by tax authorities (case file no. I FSK 1860/17). This case was led by Tomasz Michalik together with Alicja Sarna. The Supreme Administrative Court determined what criteria must be satisfied by this type of evidence in order to constitute evidence in tax proceedings. This is a landmark ruling in which the court gave tax authorities guidelines on how to conduct proceedings in a fair manner.
The award committee also honoured our case of the sale of a shopping centre(I FSK 293/17)led by Bartosz Bogdański and Tomasz Olkiewicz. This was a landmark ruling by setting a new jurisprudence and being the first in a series of rulings where courts began to accept the position of taxpayers despite the established position of tax authorities. Additionally, the ruling emphasized the importance of the protective function of individual advance tax rulings and the inability of the tax authorities to question them for trivial reasons.
It is for the second consecutive year that cases handled by MDDP are rewarded as landmark cases influencing the development of a jurisprudence favourable for taxpayers. It is also worth emphasizing that we are at the forefront in terms of the number of court cases held before administrative courts. In 2019, we won 31 cases and lost 13 cases ended with a final court ruling before the Supreme Administrative Court and Regional Administrative Courts.
The evaluation and selection of rulings was made by the award committee in the following panel: Professor Hanna Litwińczuk (University of Warsaw), Professor Bogumił Brzeziński (Nicolaus Copernicus University in Toruń), Professor Leonard Etel (University of Bialystok), Professor Artur Nowak-Far (Warsaw School of Economics) and a representative of business organizations – Piotr Kamiński Vice President of Pracodawcy RP [ Employers of Poland].
Strong market position
MDDP was ranked fifth in terms of revenues (improving its result from that year by more than 17%), while in terms of the number of tax advisors – with 35 persons with advisor qualifications – we were ranked sixth as in the previous year.
