Poland has significantly expanded the tax exemption available to foreign investment funds. The new framework may improve the tax efficiency of Polish investments, reduce withholding tax leakage and create opportunities to recover tax overpaid in previous years. The changes may be particularly important for funds based outside the EU and EEA, including funds from the United States, the United Kingdom, Canada or Australia, as well as for internally managed funds that were previously often excluded from Polish tax preferences.

The exemption may apply to capital gains, dividends, interest and certain real estate income, and can be relevant for funds investing across all sectors of the Polish economy – from real estate and infrastructure to technology and other growth sectors.
