4 New Partners at MDDP

Effective 1 July 2022, 4 new persons joined the partners of MDDP Michalik Dłuska Dziedzic i Partnerzy. Magdalena Jaworska became a partner in the VAT practice, Łukasz Kupień and Piotr Paśko in the Real Estate practice, and Agnieszka Krzyżaniak in the Transfer Pricing practice.  This significantly strengthens MDDP’s business and is part of the firm’s broad development strategy.

Magdalena Jaworska is tax adviser and attorney at law, expert in the field of VAT, specializing in taxing the digital economy. She advises in particular Polish and foreign companies operating in the e-commerce sector. She has extensive experience in advising on issues related to the split payment mechanism and due diligence in VAT. She has been involved in a number of projects aimed at reducing risk in the area of VAT and tax liability for management board members and decision makers, in particular companies operating in industries sensitive to VAT fraud. She advises clients starting operations on foreign markets and in Poland in terms of developing supply chains and documentation in international trade. She advises and represents clients in disputes with tax authorities and administrative courts. She is winner of the title “Highly Regarded” by International Tax Review in 2021.

Agnieszka Krzyżaniak is an expert in the field of transfer pricing. She specializes in comprehensive services for both Polish and international capital groups in complex projects related to business reorganization and restructuring as well as preparation and implementation of transfer pricing policies. She has extensive and many years of experience in the design, implementation and verification of intragroup settlement models, as well as in restructuring analyzes related to reorganization transfers within capital groups, with particular emphasis on cross-border operations. Provides clients with support in negotiations with the National Revenue Administration on projects related to the conclusion of advance pricing agreements (APA). She prepares transfer pricing analyzes for all possible types of intragroup transactions and prepares transfer pricing documentation, also as part of support during tax audits. She supports international companies in fulfilling their documentation obligations in accordance with the specificity of Polish and international transfer pricing regulations.

Łukasz Kupień  is a tax advisor and expert in the field of CIT and international taxes in the real estate industry. He combines tax and financial competences, comprehensively supporting Polish and foreign companies, capital groups and private equity funds in transactions, due diligence, reorganisations and withholding tax. He advised on the creation of ownership and financial structures for capital groups entering the stock exchange, issues and security of bonds on the Catalyst market, and the sale of company shares and investment platforms. He has experience in advising developers, logistics (warehouse) platforms, owners of office buildings and shopping centers, and land transactions. He advises and is an attorney in tax audits regarding the general anti-avoidance clause (GAAR) and withholding tax. In the field of withholding tax, he comprehensively verifies the rights of clients to apply the exemption or preferences, acts as an attorney in applications for an opinion on the application of preferences and in applications for a refund of overpayment in withholding tax. He specializes in the obligations of real estate companies and hybrid mismatches.

Piotr Paśko is tax advisor and expert specializing in domestic and cross-border restructuring projects. He has extensive transactional experience in the acquisition and disposal of office buildings, warehouses, residential buildings (including PRS), student houses, single plots, and entire land banks, etc., as well as extensive portfolios of real estate assets and investment platforms. He advises Polish and foreign companies as well as capital groups, developers, investors (including private equity funds) as well as individuals (HNWI), in particular on succession planning. He also supports entities from the renewable energy sector – developers and domestic and foreign investors with wind and photovoltaic (PV) farms in Poland. He has extensive experience in due diligence projects in various sectors of the economy – primarily real estate, but also renewable energy, FMCG, retail and TMT. He advises in relation to cross-border payments in his client groups – completes tax reviews e.g. on the condition of beneficial ownership and real economic activity, obtains opinions on the application of preferences, etc. Member of the Urban Land Institute. Winner of the title “Highly Regarded” by International Tax Review in 2021.
