Magdalena Marciniak among the best transfer pricing advisors

We are pleased to announce that Magdalena Marciniak, tax advisor, partner and Head of the Transfer Pricing Practice at MDDP has yet again been named one of the best transfer pricing advisors in the Tax Advisory Firms and Advisors of the Dziennik Gazeta Prawna. This is the fourth consecutive year in which Magdalena Marciniak is ranked by the DGP among the best experts in this field in Poland (2018, 2019, 2020).

At MDDP Magdalena Marciniak manages a team of almost 50 persons – one of the largest and most frequently awarded transfer pricing practices on the Polish market. She leads projects concerning documentation of transaction flows in capital groups and valuation of related-party transactions involving goods and services. She manages projects concerning restructuring of operations in capital groups as regards supply chain functionality and optimisation, development and implementation of transfer pricing policies in capital groups or support in transfer pricing tax audits. What distinguishes her on the Polish market is the unique experience in preparing applications for Advance Pricing Agreements. She has extensive experience in advising clients from the real estate, automotive, financial and pharmaceutical sectors, and it includes preparing transfer pricing documentation, reviewing transfer pricing documentation, conducting benchmark analyses or developing and implementing transfer pricing policies in capital groups. She facilitates workshops on preparing transfer pricing documentation and applying tax methods in related-party transactions. She is the only Central European expert nominated in the Transfer Pricing Practice Leader of the Year category in the prestigious European Tax Awards 2020 competition held by the International Tax Review.

MDDP with distinction in the tax litigation category 

A breakthrough judgment of the Supreme Administrative Court concerning VAT carousels (case file no. I FSK 2053/19; the case led by Kuba Warnieło), the first judgment in Poland at the Supreme Administrative Court level concerning photovoltaic panels/cells mounted on buildings (case file no. III SA/Wa 1334/20; the case led by Paweł Goś), an important judgment for a collective management organization concerning VAT exemption of remuneration for an author for library loans (case file no. I FSK 1691/17; the case led by Janka Fornalik and Paweł Goś), as well as important decisions at the authority level, e.g.: obtaining a positive ruling regarding an in-kind contribution involving a trademark (the right to demonstrate a tax loss of over PLN 27 million; the case led by Justyna Bauta-Szostak, Gniewomir Parzyjagła, Agnieszka Krzyżaniak and Alicja Sarna) and numerous positive decisions confirming overpayment of withholding tax for our clients are just a few examples of effects of the work of MDDP advisors in our clients’ cases.

For years, MDDP’s Litigation Practice has been among the leading litigators on the Polish market, as evidenced by the Polish and international awards it has received (World Tax, “Tax Controversy” category; the Dziennik Gazeta Prawna, “Tax Litigation” category). The 16th Ranking of Tax Firms and Advisors by the Dziennik Gazeta Prawna shows that despite the second year of the pandemic and the ever-changing legal environment MDDP managed to close last year with very good results – in terms of revenue and the number of tax advisors, we are still number 5 in Poland!
